Cabinet Resolution Regarding the National Committee to Combat Human Trafficking (NCCHT)

The Cabinet,
− Having reviewed the Constitution;
− Federal Law No. (1) of 1972, Regarding the Competences of Ministries and the Powers of Ministers, as amended;
− Federal Law No. (51) of 2006 Regarding the Combat of Human Trafficking Crimes, as amended;
− Federal Decree by Law No. (11) of 2008 Regarding Human Resources in the Federal Government, as amended;
− Cabinet Resolution No. (15) of 2007 Regarding the Formation of the National Committee to Combat Human Trafficking Crimes, as amended;
− Cabinet Resolution No. (47) of 2020 Regarding the Organizational Structure of the Ministry of Justice; and
− Upon the proposal of the Minister of Justice and the Cabinet’s approval thereof;
Hereby resolves as follows:
Article (1) Definitions
For the purposes of implementing the provisions of this Resolution, the following terms and expressions shall have the meanings assigned to each of them, unless the context requires otherwise:
State: The United Arab Emirates (UAE).
Ministry: The Ministry of Justice.
Minister: The Minister of Justice.
Competent Authorities: The concerned federal authorities.
Concerned Authorities: The concerned local authorities.
Committee: The National Committee to Combat Human Trafficking.
Article (2) Formation of the Committee
The National Committee to Combat Human Trafficking (NCCHT) shall be formed under the chairmanship of the Minister of Justice, with membership of representatives from each of the following entities:
1. Ministry of Interior.
2. Ministry of Foreign Affairs and International Cooperation.
3. Ministry of Health and Prevention.
4. Ministry of Community Development.
5. Ministry of Human Resources and Emiratisation.
6. Ministry of Justice.
7. Central Bank of the UAE (CBUAE).
8. Federal Authority for Identity, Citizenship, Customs and Port Security.
9. State Security Department.
10. The Federal Public Prosecution.
11. Public Prosecution – Abu Dhabi.
12. Public Prosecution – Dubai.
13. Public Prosecution – Ras Al Khaimah.
14. Emirates Red Crescent.
15. National Human Rights Institution.
16. Emirates Human Rights Association.
17. Abu Dhabi Center for Sheltering and Humanitarian Care – Ewaa.
18. Dubai Foundation for Women and Children.
19. Aman Shelter for Women and Children in Ras Al Khaimah.
Article (3) Nomination of Committee Members
The Chairman of the Committee shall issue a decision naming the Committee’s members based on the nominations received from the entities listed in Article (2) hereof. Furthermore, the Committee shall elect, from among its members, a Deputy-Chairman, who shall assume the Chairman’s duties in their absence.
Article (4) Committee’s Competences
The Committee shall exercise the competences stipulated in the aforementioned Federal Law on Combating Human Trafficking Crimes. For the purposes of fulfilling its mandate, the Committee may:
1. Communicate and coordinate with the Competent Authorities and the Concerned Authorities related to the Committee’s competencies.
2. Establish working groups and specialized subcommittees from among its members to monitor and implement tasks assigned thereto by Committee.
3. Seek assistance from any individuals deemed appropriate by the Committee from the Competent Authorities, Concerned Authorities, or experts to provide advice, information, or clarification.
4. Invite specialists, technicians, consulting firms, and research and studies centers to attend meetings and provide opinions on technical matters, without having voting rights.
Article (5) Administrative Office
The Committee shall have an administrative office to be established by a resolution issued by the Minister. The resolution establishing the office shall define its functions and affiliation.
Article (6) Annual Report
The Committee shall prepare an annual report detailing the outcomes of its activities, its recommendations, and the implementation mechanisms thereof. The Chairman of the Committee shall submit such report to the Cabinet by 31 December of each year.
Article (7) Committee’s Affiliation and Rules of Procedure
1. The Committee shall be affiliated with the Ministry of Justice, and its allocated budget shall be transferred from the Ministry of Foreign Affairs and International Cooperation.
2. A decision regarding the Committee’s rules of procedure shall be issued by the Chairman subject to the approval of its members.
Article (8) Repeals
Cabinet Resolution No. (15) of 2007, referred to above, along with its amendments, is hereby repealed. Any provision that contradicts or conflicts with the provisions of this Resolution shall likewise be repealed.
Article (9) Publication and Entry into Force
This Resolution shall be published in the Official Gazette, and shall enter into force from the day following the date of its publication.
